Privacy by Design Principles
Privacy by Design (PbD) embeds privacy protections into the design and architecture of systems from the start, rather than bolting them on after development. This approach is mandated by GDPR (Article 25) and increasingly expected by regulators worldwide.
The 7 Foundational Principles
1. Proactive Not Reactive
Anticipate and prevent privacy-invasive events before they happen.2. Privacy as the Default Setting
No action should be required from the individual to protect their privacy.3. Privacy Embedded into Design
Privacy is integral to the system, not an add-on.4. Full Functionality (Positive-Sum)
Accommodate all legitimate interests: privacy AND security, not privacy OR security.5. End-to-End Security
Full lifecycle protection from collection through deletion.6. Visibility and Transparency
Keep operations transparent and verifiable.7. Respect for User Privacy
Keep the interests of the individual paramount.Engineering Implementation
Data Minimization
# BAD: Collect everything
user_data = request.json # name, email, phone, address, DOB, SSN, ...
# GOOD: Collect only what's needed
user_data = {
"name": request.json["name"],
"email": request.json["email"]
}
Purpose Limitation
Document and enforce the purpose for each data element:DATA_PURPOSES = {
"email": ["authentication", "notifications"],
"address": ["shipping"],
"phone": ["2fa", "delivery_updates"]
}
Consent Management
Implement granular consent tracking:- Separate consent for each processing purpose
- Easy withdrawal mechanism
- Consent version tracking
- Proof of consent storage
Data Subject Rights
Build APIs for GDPR rights:- Access: Export all data for a user
- Rectification: Allow data correction
- Erasure: Delete all personal data
- Portability: Export in machine-readable format
- Objection: Opt out of specific processing
Where SuperClue Fits
SuperClue does not review application design for privacy. Its DPDP framework scan checks what your website shows about consent, purpose limitation, and data principal rights, and asks for evidence for the rest.
